Fingerprinting Requirements


Fingerprinting
  • Livescan is the electronic scanning of fingerprints and is becoming the standard method for submission of fingerprints.

  • For child care facilities, all employees and volunteers must have a criminal background check (with the exception of relatives of a child in care who are not used to replace staff in providing direct care and supervision of children).

  • Fingerprints must be submitted to the Department of Justice prior to the presence of a worker or volunteer in the facility (this applies to both child care centers and family child care homes). The Department of Justice is to complete a check within 14 days of receiving the fingerprints.

  • A request for transfer of a criminal records clearance must be in writing. A copy of a state-issued photo identification (such as a driver's license) must be submitted with the request.

  • Failure to submit fingerprints as required may subject licensees to a $150 civil penalty per violation.

Family child care providers and other facilities serving six or fewer children are exempt from the Department of Justice and FBI fingerprint processing fees. However, they are required to pay for the Child Abuse Index and fingerprint fee.

The Community Care Licensing Division has Livescan technology available in most of their district offices. Livescan takes a computer image of a persons fingerprint and transmits it directly to the Department of Justice. It will allow criminal record checks to be completed within three days. Under Livescan, the Department of Justice expedite fee will be eliminated. The fee for obtaining a fingerprint by Livescan in a Community Care Licensing District Office is $15. Some local Sheriff Departments are now connected with Community Care Licensing and Livescan can be done at those sites.

TrustLine is for license-exempt providers. TrustLine applicants are required to submit a set of fingerprints in order to become a TrustLine registrant. The Department of Justice checks for criminal violations, other than minor traffic violations, and reports of child abuse through the Child Abuse Central Index. As determined by the Department of Justice, exemptions are granted to individuals, upon appeal, who demonstrate such good character as to justify an exemption.
